THIS AGREEMENT made this              day of                      ,                     ,by and between Apple Home
Inspections, Inc. (hereinafter “APPLE”) and the undersigned (hereinafter “CLIENT”).

1. APPLE agrees to perform a limited visual inspection of the subject house and to provide CLIENT with a written opinion informing CLIENT apparent deficiencies that Apple both observed and deemed to be major material defects. The inspection will be of clearly visible and readily accessible areas of the house. Apple may offer comments on items or systems as a courtesy, but these comments will not comprise the bargained-for report. The report is only supplementary to the seller’s disclosure.

2. The visual inspection shall be performed in a manner consistent with the Standard of Practice of the National Association of Certified Home Inspectors (NACHI). A copy of which is available at www.NACHI.org and prior to the inspection.

3. The inspection and written opinion are performed and prepared for the use of CLIENT, who gives APPLE permission to discuss observations with realtors, owners, repair persons and other interested parties. APPLE accepts no responsibility for use or misinterpretation by third parties.

4. The written report does not cover (unless specifically stated):

* underground utilities * playground equipment * causes of the need for a repair * pools
 *water wells or springs * detached structures * water treatment or filters * fuel tanks
 *cosmetic conditions * defects unobserved * code or zoning compliance * appliances
 *central vacuum * unique or customized systems * interiors of chimneys & flues * fuel quality
 *drain field, cesspool, or tank * environmental hazards * fire alarms or sprinkler systems * solar systems
 *security systems * personal property * items not permanently installed * smoke alarms
 *actual age or life expectancy of any component or system * any component or system which was not observed
 the presence or absence of pests such as wood damaging organisms, rodents, or insects or damage relating to them

5. The purpose of this visual inspection is to report to CLIENT the observed deficiencies of the inspected systems or items at the time of the inspection only, which were both readily visible and which APPLE deemed to be major material defects in the inspector’s opinion.

6. APPLE WANTS THE CLIENT TO KNOW:
* APPLE does NOT claim expertise in specific home components or systems.
* CLIENT should NOT expect APPLE to find every problem that exists or ever could exist, but only that APPLE will report deficiencies that APPLE both readily observed and deemed to be major material defects.
* APPLE will NOT move personal property, debris, furniture, equipment, ceiling tiles, floor covering or like materials which may impede access or limit visibility.
* Equipment, components and systems will NOT be dismantled, such as a heating or cooling unit.
* The inspection is NOT intended to be technically exhaustive.

7. In the event of a claim against APPLE, CLIENT agrees to supply APPLE with a written notification of adverse conditions within 14 days of discovery and access to the premises.

8. APPLE is not responsible for any claim if repairs are made or money is spent without notifying APPLE. Failure to comply with the above conditions will release APPLE, its employees, and its agents, from any and all obligations. In the event that CLIENT institutes litigation but fails to obtain a judgment against APPLE in a court of law, then the CLIENT will pay all legal costs, expenses and fees of APPLE in defending said claims.

9. Any legal action brought against APPLE must be within one year from the date of the inspection. Failure to do so is a full and complete waiver of any rights, actions or causes of actions that may have arisen Time is expressly of the essence herein.

10. CLIENT agrees that the maximum liability of APPLE, its employees, and its agents, is limited to an amount not to exceed the fee paid for the inspection service.

11. Payment is due upon completion of the on-site inspection service.

12. CLIENT understands and agrees that if they are not present at the time of the inspection and therefore did not sign this agreement that this agreement will form part of the inspection report and acceptance of the report will constitute acceptance of the terms and conditions of this agreement.

13. If any provision of this agreement is declared invalid or unenforceable by any court, the remaining provisions will remain in effect. This agreement represents the entire agreement between the parties. No change or modification shall be enforceable against any party unless such change or modification is in writing and signed by the parties. This agreement shall be binding upon and enforceable by the parties and their heirs, executors, administrators, successors and assigns.

This legal binding contract is understood and agreed to, and CLIENT acknowledges receipt of a copy of this agreement.
